RETAIL FOOD OUTLET OPERATORS

Auburn City Council is the Enforcement Agency under the provisions of the Food Act 2003 and is responsible for the regulating of retail food businesses within the Auburn Local Government Area,  which incorporates Sydney Olympic Park Precinct.

As with other events held within the precinct, Council will a undertake food safety surveillance program of the all temporary retail food businesses operating during the event. This program includes food safety and compliance inspections to ensure that the requirements of the Food Act 2003 and Food Safety Standards are being complied with.

All temporary retail food businesses operating at the Sydney Royal Easter show are to complete and submit council’s application form to register a temporary food outlet.

FOOD SAFETY SUPERVISOR (FSS)

In 2009 new legislation was passed that will require food businesses that process and sell ready to eat potentially hazardous foods will be required to appoint at least one trained Food Safety Supervisor. This requirement came in force as of 1 October 2011. Therefore relevant temporary outlets will require a certified food safety supervisor for the 2012 Sydney Royal Easter Show.

Under the Food Safety Supervisor provisions, at least one FSS is required at each outlet because each outlet would be classified as a premises [Refer to definition of ‘premises’ under Section 4 and ‘temporary premises’ under Section 106 of the Food Act 2003 (NSW)]. Although a business may run many outlets in the same arena or ground, each one is effectively a premises processing and selling food by retail; therefore 1 FSS would be required at each outlet. Similarly, 3 hamburger shops in the same shopping mall, is required to have a different FSS for each premises. Temporary premises do not need to notify the council of their FSS, however they are required to keep a copy of the FSS Certificate on the premises at all times.

Further information regarding the Food Safety Supervisor requirements is available online at
NSW Food Authority or by contacting Council’s Environmental Health Officers on 9735 1222.
