Increase the maximum floor space ratio for certain land zoned B4 Mixed Use and R4 High Density Residential within the Auburn City local government area.

Summary

On 28 September, 2011, Auburn City Council submitted a planning proposal to the Department of Planning and Infrastructure for assessment under the LEP making gateway process.  The planning proposal is described as follows:
 
Planning Proposal – Amendment to Auburn LEP 2010: Proposal to increase floor space ratio (FSR) controls applying to certain land zoned B4 Mixed Use and R4 High Density Residential in the Auburn local government area.
 
Specifically, the planning proposal seeks to amend Auburn LEP 2010 to achieve:
 
  • an increase to the maximum FSR from 3:1 and 3.6:1 to 5:1 for land zoned B4 Mixed Use that has a maximum building height of 32m (8 storeys) or 36m (9 storeys); and
  • an increase to the maximum FSR from 1.4:1 to 2:1 for all land zoned R4 High Density Residential, with the exception of land at 2-36 Church Street, Lidcombe (owned by Housing NSW), and the corner of Rawson Road and Macquarie Street, Auburn.

Resolution

The planning proposal responds to parts 1(a) and 1(b) of the resolution of Council made at the Ordinary Meeting of 20 October, 2010 (Item 257/10). 

Status

The planning proposal was assessed by the Department and received conditional approval on 28 November, 2011. As part of the conditions of the gateway determination, Council must undertake the following (in summary):
 
  • An urban design study
  • A Traffic, Transport and Accessibility Study
  • A study to demonstrate the proposal is consistent with the s.117 Direction 4.3 Flood Prone Land; and
  • Community consultation as stipulated
Council has a 12 month deadline from the date of issue of the gateway determination to meet these conditions, revise and exhibit the planning proposal and resubmit the planning proposal to the Department.
